Legal terms and conditions for the competition on Instagram and Facebook; Soivre Cosmetics Christmas Hamper Raffle
1.- SOIVRE COSMETICS of VCS FARMA Group
The company VCS Farma with registered office at Polígono Ind. Les Guixeres, C/Plàstic 21 (08915- Badalona) with CIF B60281565 is organising a DRAW called La Cesta de Navidad de Soivre Cosmetics (Soivre Cosmetics Christmas Hamper)
2.- Disassociation from Instagram and Facebook
Instagram/Facebook does not sponsor, endorse or administer this promotion in any way, nor is it associated with it. The user dissociates himself/herself completely from Instagram/Facebook and is aware that he/she is providing his/her information to VCS Farma and not to Instagram/Facebook. The information you provide will be used to communicate the prize and future commercial actions.
3.- Object and mechanics of the competition.
Take part in the Soivre Cosmetics Christmas Hamper Raffle. The draw will have 4 winners, two for Facebook and two for Instagram.

- Red enamel 6ml
- Pretty lips red 3,5g
To be eligible for the prize, participants must make a purchase on the soivrecosmtics.com website between 4 and 20 December 2020 until midnight.
The draw will take place on 21 December 2020 and the prize will be awarded randomly among all participants who have entered the competition.
Participation in the prize draw implies the winner's express authorisation for his/her name to be published on the same social network and website. The winner will be asked to send a picture of him/her with the prize, once it has been delivered.
Inappropriate, incomplete or fraudulent entries will be deleted.
4.- Duration and Scope
The activity will be carried out in the geographical area of Spain, Balearic Islands, excluding the Canary Islands, Ceuta and Melilla.
The start date of the competition will be 4th December until 20th December 2020 at midnight.
5.-Participation requirements
Eligible to participate in the draw:
All natural persons over 18 years of age with residence in Spain, Balearic Islands, excluding Canary Islands, Ceuta and Melilla, and send the form with all the required information correctly.
The following are not eligible to participate: Fraudulent profiles.
6.- Selection of the winner, alternate winner, communication and delivery
The winner will not be chosen by a jury and only one winner will be chosen.
If the winner is not contacted within 5 days of the first contact attempt, or declines the prize, a new winner will be selected, and the previous winner will forfeit his/her right to claim the prize.
The name of the winner will also be communicated on the Instagram and Facebook accounts of @soivrecosmetics and with the possibility of advertising in other communication elements of the ecommerce (VCS Farma) and the person will be contacted once the promotion is over.
VCS Farma will send the gift directly to the winner, thanks to the data provided by the winner.
The gift will be sent by courier to the address indicated by the winner, with the cost of delivery to be paid by the company VCS Farma.
7.- Prize
The Christmas hamper including the products specified in section 3.
Reservations and limitations
It shall be understood, by way of example, but not limited to, that fraud occurs when the alleged use of applications independent of the Website is detected; the misuse of server queries and all those behaviours that may be apparently abusive and/or malicious.
The discovery of any of these circumstances during the competition will result in automatic disqualification from the competition, as well as the loss of the prize if it has been awarded.
The company VCS Farma is exempt from any liability in the event of any error in the data provided by the winners themselves that would prevent their identification.
Igualmente, no se responsabiliza de las posibles pérdidas, deterioros, robos o cualquier otra circunstancia imputable a correos que puedan afectar al envío de los premios.
La empresa VCS Farma se reserva el derecho de emprender acciones judiciales contra aquellas personas que realicen cualquier tipo de acto susceptible de ser considerado manipulación o falsificación del concurso.
La empresa VCS Farma excluye cualquier responsabilidad por daños y perjuicios de toda naturaleza que puedan deberse a la falta temporal de disponibilidad o de continuidad del funcionamiento de los servicios mediante los que se participa en la promoción, a la defraudación de la utilidad que los usuarios hubieren podido atribuir a los mismos, y en particular, aunque no de modo exclusivo, a los fallos en el acceso a las distintas páginas y envíos de respuestas de participación a través de Internet.
La empresa VCS Farma se reserva el derecho a efectuar cambios que redunden en el buen fin del concurso cuando concurra causa justa o motivos de fuerza mayor que impidan llevarla a término en la forma en que recogen las presentes bases.
La empresa VCS Farma se reserva el derecho a aplazar o ampliar el período del concurso, así como la facultad de interpretar las presentes bases legales.
Asimismo, la empresa organizadora quedará exenta de toda responsabilidad si concurriere alguno de los casos señalados, así como de cualquier responsabilidad por los daños y perjuicios que pudiesen ocasionarse durante el disfrute del premio.
9.- Protección de datos
LABORATORIOS VCS-FARMA, S.L. es el Responsable del tratamiento de los datos personales del Interesado y le informa que datos serán tratados de conformidad con lo dispuesto en las normativas vigentes en protección de datos personales, el Reglamento (UE) 2016/679 de 27 de abril de 2016 (GDPR) y la Ley Orgánica 3/2018, de 5 de diciembre (LOPDGDD), por lo que se le facilita la siguiente información del tratamiento:
Fin del tratamiento: Gestión de los datos de los participantes a este sorteo.
Base de legitimación del tratamiento: consentimiento del interesado mediante la aceptación de las siguientes bases.
Criterios de conservación de los datos: se conservarán durante no más tiempo del necesario para mantener el fin del tratamiento y cuando ya no sea necesario para tal fin, se suprimirán con medidas de seguridad adecuadas para garantizar la seudonimización de los datos o la destrucción total de los mismos.
Comunicación de los datos: no se comunicarán los datos a terceros, salvo obligación legal o aquellos prestadores vinculados al Responsable que actúan como Encargados del Tratamiento.
Derechos que asisten al Interesado:
– Derecho a retirar el consentimiento en cualquier momento.
– Derecho de acceso, rectificación, portabilidad y supresión de sus datos y a la limitación u oposición a su tratamiento.
– Derecho a presentar una reclamación ante la Autoridad de control www.aepd.es si considera que el tratamiento no se ajusta a la normativa vigente.

10.- Aceptación de las bases.
La simple participación en el concurso implica la aceptación de las presentes Bases, por lo que la manifestación en el sentido de no aceptación de la totalidad o parte de las mismas implicará la exclusión del participante y como consecuencia de ello, la empresa VCS Farma quedará liberada del cumplimiento de la obligación contraída con dicho participante.
